Jenny Eden Coaching is owned and operated by me, Jenny Eden Berk, MSEd. In this Privacy Policy, "I," "me," and "my" mean Jenny Eden Berk, MSEd, doing business as Jenny Eden Coaching. I operate jennyedenberk.com, my online community, my digital products, and my email list (together, the "Services").

This page explains how I collect, use, and disclose personal data when you use the Services, and the choices you have. I use your data to provide and improve the Services. By using the Services, you agree to the collection and use of information as described here. Terms not defined here have the meanings given in my Terms and Conditions at https://www.jennyedenberk.com/terms-conditions.

Definitions

Services. My website (jennyedenberk.com), my online community, my digital products, and my email list.

Personal Data. Data about a living person who can be identified from that data, or from that data together with other information I have or am likely to have.

Usage Data. Data collected automatically, either generated by using the Services or from the Services' infrastructure, such as how long you spend on a page.

Cookies. Small pieces of data stored on your device.

Data Controller. The person who decides why and how personal data is processed. For this Privacy Policy, I am the Data Controller of your Personal Data.

Data Processors (or Service Providers). Companies that process data on my behalf. I use the providers listed in the Service Providers section below.

Data Subject (or User). Any living person who uses the Services and is the subject of Personal Data.

Information I Collect and How I Use It

I collect several types of information to provide and improve the Services.

Personal Data

While you use the Services, I may ask for personal information that can be used to contact or identify you. This may include, but is not limited to:

  • Email address

  • First name and last name

  • Cookies and Usage Data

Emails

When you sign up for a free product, join my list, join my community, or buy from me, I add your name and email address to my email list. I use it to deliver what you asked for and to send related emails and offers. Accepting this policy includes accepting those emails. Every email has a one-click unsubscribe link, and unsubscribing does not affect your access to products you already have.

Usage Data

I may also collect information about how the Services are accessed and used. This may include your computer's IP address, browser type and version, the pages you visit, the time and date of your visit, time spent on pages, unique device identifiers, and other diagnostic data.

Tracking and Cookies Data

I use cookies and similar technologies, such as beacons, tags, and scripts, to track activity on the Services, hold certain information, and improve and analyze the Services. Cookies are small files that may include an anonymous unique identifier. They are sent to your browser from a website and stored on your device.

You can set your browser to refuse all cookies or to tell you when a cookie is being sent. If you refuse cookies, some parts of the Services may not work.

Examples of cookies I use:

  • Session cookies to operate the Services.

  • Preference cookies to remember your preferences and settings.

Use of Data

Jenny Eden Coaching uses the data I collect to:

  • Provide and maintain the Services

  • Notify you about changes to the Services

  • Let you take part in interactive features when you choose to

  • Provide customer support

  • Analyze information so I can improve the Services

  • Monitor how the Services are used

  • Detect, prevent, and address technical issues

  • Send you news, special offers, and information about other products, services, and events I offer that are related to what you have bought or asked about, unless you opt out.

Legal Basis for Processing Personal Data (GDPR and UK GDPR)

If you are in the European Economic Area (EEA) or the United Kingdom, my legal basis for collecting and using your Personal Data depends on the data and the context in which I collect it. I may process your Personal Data because:

  • I need to perform a contract with you

  • You have given me permission

  • The processing is in my legitimate interests and is not overridden by your rights

  • It is needed for payment processing

  • I need to comply with the law

Retention of Data

I keep your Personal Data only as long as needed for the purposes in this Privacy Policy. I keep and use it as needed to meet legal obligations (for example, if I am required to keep data under applicable law), resolve disputes, and enforce my agreements and policies.

I also keep Usage Data for internal analysis. Usage Data is generally kept for a shorter time, unless it is used to strengthen security or improve how the Services work, or I am legally required to keep it longer.

Transfer of Data

Your information, including Personal Data, may be transferred to and kept on computers outside your state, province, country, or other government area, where data protection laws may differ from those where you live.

If you are outside the United States and give me information, please note that I transfer the data, including Personal Data, to the United States and process it there. Your acceptance of this Privacy Policy, followed by your submission of information, is your agreement to that transfer.

I take reasonable steps to make sure your data is treated securely and under this Privacy Policy. I will not transfer your Personal Data to an organization or country unless there are adequate controls in place, including for the security of your data.

Disclosure of Data

I may disclose your Personal Data if I believe in good faith that it is necessary to:

  • Comply with a legal obligation

  • Protect and defend the rights or property of Jenny Eden Coaching

  • Prevent or investigate possible wrongdoing in connection with the Services

  • Protect the personal safety of users of the Services or the public

  • Protect against legal liability

I do not sell your Personal Data.

Security of Data

Your data's security matters to me, but no method of transmission over the internet or method of electronic storage is 100% secure. I use commercially reasonable means to protect your Personal Data, and I cannot guarantee absolute security.

Your Data Protection Rights (GDPR and UK GDPR)

If you live in the EEA or the United Kingdom, you have certain data protection rights. I take reasonable steps to let you correct, amend, delete, or limit the use of your Personal Data. To find out what Personal Data I hold about you, or to have it removed from my systems, please contact me.

In certain circumstances, you have the following rights:

  • Access, update, or delete. You can access, update, or request deletion of the information I have on you. Where possible, you can do this in your account settings. If you cannot, contact me and I will help.

  • Rectification. You can have inaccurate or incomplete information corrected.

  • Objection. You can object to my processing of your Personal Data.

  • Restriction. You can ask me to restrict the processing of your Personal Data.

  • Portability. You can ask for a copy of your information in a structured, machine-readable, commonly used format.

  • Withdrawing consent. You can withdraw your consent at any time where I relied on consent to process your Personal Data.

I may ask you to verify your identity before I respond to a request.

You also have the right to complain to a data protection authority about how I collect and use your Personal Data. In the EEA, contact your local data protection authority. In the United Kingdom, contact the Information Commissioner's Office (ico.org.uk).

Service Providers

I use third-party companies to help provide the Services, perform Service-related tasks, and help me understand how the Services are used. These providers can access your Personal Data only to do those tasks for me, and they are required not to disclose or use it for anything else. They include:

  • Squarespace (my website)

  • Kit (my email list and landing pages)

  • Heartbeat (my online community)

  • Substack (my newsletter)

  • Notion (the platform my recipe database and planner templates run on)

  • Loom (hosting for walkthrough videos)

Each has its own privacy policy that governs how it handles your data.

Analytics

I may use third-party providers to monitor and analyze use of the Services.

Google Analytics is a web analytics service from Google that tracks and reports website traffic. Google uses the data to track and monitor use of the Services, and shares it with other Google services. Google may use the data to personalize ads in its own advertising network. You can opt out by installing the Google Analytics opt-out browser add-on, which stops the Google Analytics JavaScript from sharing visit activity with Google Analytics. Payments

I may offer paid products and services. I use third-party services for payment processing, provided through the platforms I sell on. I do not store or collect your payment card details. That information goes directly to the payment processor, whose use of your information is governed by its own privacy policy. These processors follow the standards set by PCI-DSS. The processors may include Stripe (https://stripe.com/privacy) and PayPal (https://www.paypal.com/webapps/mpp/ua/privacy-full).

Links to Other Sites

The Services may contain links to sites I do not operate. If you click a third-party link, you will go to that site. I strongly recommend you review the privacy policy of every site you visit. I have no control over, and take no responsibility for, the content, privacy policies, or practices of third-party sites.

Children's Privacy

The Services are not meant for anyone under 18 ("Children"). I do not knowingly collect personal information from anyone under 18. If you are a parent or guardian and know that your child has given me Personal Data, please contact me. If I learn that I have collected Personal Data from a child without verified parental consent, I will take steps to remove it from my servers.

Changes to This Privacy Policy

I may update this Privacy Policy from time to time. I will post the new version on this page. If a change is significant, I will tell you by email or with a prominent notice on the Services before it takes effect, and I will update the effective date at the top. Please review this policy periodically. Changes take effect when they are posted.
